Participation
Participation in the auction is restricted to individuals with full legal capacity or to companies represented by their duly authorized legal representatives having full legal capacity. A prerequisite for participation is the timely prior registration and our confirmation of such registration. For registration\, the bidder must submit: a copy of a valid passport or national identity car d\; for companies\, a current commercial register extract evidencing the au thority of the managing director or other authorized representative\; where applicable\, a written power of attorney\; and a transfer of EUR 1.00 from the bidder's own bank account maintained in the bidder's name for identity verification purposes. Registration must be completed no later than one da y before the auction. Bidding Participation in the auction requires prior r egistration in accordance with the German Anti-Money Laundering Act (Geldw& auml\;schegesetz &ndash\; GwG). The aucti on will be broadcast live via our auction platform\, where registered bidde rs may participate and submit bids online. Written Bids and Telephone Bids Written bids and registrations for telephone bidding (a written security bi d is required\; subject to staff availability and prior agreement) are acce pted only if accompanied by a bank confirmation issued by a German credit i nstitution. Written and telephone bids are also avail able for online auctions. Telephone bidders will be contacted approximately five minutes before the respective lot is offered. Security Deposit In acc ordance with the German Anti-Money Laundering Act (GwG)\, we are legally re quired to verify the identity of all bidders. Accordingly\, each bidder mus t transfer a security deposit of EUR 1.00 from a personal bank account held in the bidder's own name. Payments from third-party accounts cannot be acc epted. We reserve the right\, where previous payment defaults or payment re fusals are known to us\, to require an increased security deposit of up to the anticipated hammer price. Such amount shall be determined by the auctio neer appointed to conduct the auction. The security deposit will either: be credited against the purchase price\, or be refunded after completion of t he auction. Should the successful bidder fail to complete the purchase or o therwise breach Sections 14 or 15 of the Auction Terms and Conditions\, the security deposit shall be forfeited to us as liquidated damages. Buyer's P remium The successful bidder shall pay a buyer's premium plus 19% German VA T on the premium according to the following scale: Hammer Price Buyer's Pre mium up to EUR 99\,999 25% + VAT EUR 100\,000 &ndash\; 199\,999.99 18% + VA T EUR 200\,000 &ndash\; 349\,999.99 15% + VAT EUR 350\,000 &ndash\; 499\,99 9.99 12% + VAT EUR 500\,000 &ndash\; 699\,999.99 10% + VAT EUR 700\,000 &nd ash\; 999\,999.99 6% + VAT EUR 1\,000\,000 &ndash\; 3\,999\,999.99 3% + VAT from EUR 4\,000\,000 2% + VAT Award of the Auction (Hammer) The hammer pri ce is invoiced without VAT (the buyer's premium is subject to VAT where app licable). Upon the fall of the hammer\, the risk passes immediately to the successful bidder.
Payment must be made immediately in Euro by one of the following methods: instant online bank transfer\, same-day wire tran sfer (to be arranged with your bank in advance)\, German Bundesbank cheque (LZB cheque)\, or irrevocable bank-certified cheque. As we act in a fiducia ry capacity and are obliged to ensure immediate payment\, deferred bank tra nsfers cannot be accepted. Language The auction is conducted exclusively in German\, which is the official language required for this legally regulate d public auction procedure. We welcome bidders from all countries. We may b e able to provide limited assistance in English\, French or Spanish. Assist ance in other languages cannot be guaranteed. If you do not fully understan d the German language\, you are strongly advised to appoint a qualified int erpreter to ensure that all announcements\, auction conditions and legal do cuments are fully understood. Bids may be submitted: in person\, online\, b y telephone (upon request and subject to staff availability)\, or in writin g. Written bids must be received and confirmed by us no later than 24 hours before the auction. Timely registration and receipt of the required securi ty deposit are mandatory for all bidding methods. Security The auction prem ises may be monitored by video surveillance for security purposes. Any thef t or attempted theft will be reported to the competent criminal authorities . Transfer Documentation The transfer documentation will be issued immediat ely after full payment of the hammer price and buyer's premium has been rec eived. The documents will be sent by registered mail with acknowledgement o f receipt.
